Terms of Service

By accessing or using Grade My Take (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Zaela LLC, an Ohio limited liability company (“we,” “us,” or “our”).

You must be at least 13 years old to use the App. Optional adult content available through paid subscription is restricted to users 18 or older; before enabling such content, you will be asked to provide your date of birth to confirm you are at least 18, and by submitting that information you represent and warrant that the date you provided is accurate and that you are at least 18 years old. We store your date of birth and the timestamp of your confirmation as a record of this representation. Users between 13 and 18 represent that a parent or legal guardian has reviewed and accepted these Terms.

You may use the App without creating an account. Signing in with a valid Google account enables score history, streak tracking, leaderboard eligibility, and the friend features described in Section 7. You are responsible for all activity under your account. Notify us at info@zaelasolutions.com if you suspect unauthorized access.

You agree not to:

• Submit content that is hateful, threatening, sexually explicit (except where permitted under the adult-content tier), infringes another party’s rights, or is otherwise inappropriate
• Set a display name that is offensive, misleading, impersonates another person, or violates any applicable law
• Attempt to circumvent play limits, bot verification, or rate limiting through any technical means
• Use automated scripts or bots to interact with the App
• Manipulate community voting through duplicate or coordinated accounts, paid voting, or any scheme designed to inflate or suppress scores
• Reverse engineer, hack, or otherwise compromise the App’s security

Your responses are processed by third-party AI to generate scores, explanations, and short summaries. All AI-generated output is subjective and provided for entertainment purposes only. It does not measure intelligence, knowledge, ability, or any other personal trait. The same response may receive different output on different evaluations. AI output may occasionally be inaccurate or unexpected, and we are not responsible for the content of AI-generated responses. AI-generated summaries may not exactly match the wording you submitted and are not reviewed by a human before being displayed.

We apply automated safety screening to submissions to detect content that expresses self-harm or suicidal intent. When such content is detected, the normal scoring flow is replaced with information about mental health crisis resources. This automated screening is imperfect, is not a substitute for professional mental health care, and the App is not a crisis intervention service. If you are in crisis, please contact 988 (US), Crisis Text Line (text HOME to 741741), Samaritans (UK & Ireland, 116 123), or another appropriate emergency resource. To the fullest extent permitted by law, we are not liable for any outcome arising from the operation or non-operation of this screening.

You retain ownership of the responses you submit. By submitting, you grant Zaela LLC a limited, non-exclusive license to transmit your response to our AI provider, store an AI-sanitized version of your response together with the AI-generated reaction and tier ratings shown on your result screen, and — if you set a public display name or share your score — display the AI-sanitized response publicly on the leaderboard and in share previews. By choosing to set a display name or share your score, you consent to the corresponding public visibility. We do not use your responses to train AI models, and we do not use them for any purpose beyond operating the App.

To keep the public leaderboard family-friendly and free of duplicates, we may hide individual submissions from public display at our discretion, including (but not limited to) submissions that contain inappropriate content, substantially duplicate another player’s answer, or otherwise violate the Acceptable Use rules in Section 4. Hidden submissions may still be scored and remain visible to the player who submitted them; they are simply not shown on the public leaderboard or in share previews.

Signed-in players who have played the current day’s round may cast a single upvote or downvote on each other entry shown on the public leaderboard. Votes are final once cast and contribute to a community-adjusted score that is displayed publicly alongside the AI score and determines the ranking order within the daily leaderboard. We reserve the right to disregard or remove votes that we reasonably believe are the result of coordinated manipulation, duplicate accounts, or other abuse, and to adjust or recompute community-adjusted scores at any time.

Signed-in players may add other signed-in players as mutual friends, subject to a per-player cap. Friend connections are created by sharing and opening a personal invite link, which any recipient who is signed in may use to add you as a friend. Do not share your invite link with people you do not want as friends. Either party may remove the connection at any time, which deletes it for both sides without notification. Friend connections are used to display a friends-only view of the daily leaderboard and the friend list on each player’s own settings; they are not displayed to anyone else. We reserve the right to limit, throttle, or revoke invite functionality in cases of suspected abuse.

We offer optional paid subscriptions that unlock additional features. Current pricing and feature details are shown within the App. Payment is processed by Stripe; we never receive or store your payment card details. Subscriptions renew automatically until canceled. You may cancel at any time, and access continues until the end of your current billing period. We do not offer refunds for partial billing periods. Pricing and features are subject to change with reasonable notice. By subscribing, you agree to Stripe’s terms of service.

If you opt in, we send daily reminder emails. Email reminders are strictly opt-in and never enabled by default. You may opt out at any time by clicking the unsubscribe link in any email or by toggling reminders within the App. For more details on how we handle your email, see our Privacy Policy.

The App, including its design, code, prompts, and branding, is owned by Zaela LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time from within the App, which immediately removes your account and associated data. You may also request deletion by contacting info@zaelasolutions.com.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZAELA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED $100.

You agree to indemnify, defend, and hold harmless Zaela LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the App or violation of these Terms.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the state or federal courts located in Ohio, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. We may modify these Terms at any time and will indicate the date of the most recent update at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zaela LLC regarding the App.
