Terms of Service

By accessing or using Grade My Take (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Zaela LLC, an Ohio limited liability company (“we,” “us,” or “our”).

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

You must sign in using a valid Google account to use the App. You are responsible for all activities that occur under your account. You agree to notify us immediately at info@zaelasolutions.com if you suspect unauthorized access to your account.

You agree not to:

• Submit answers that are offensive, hateful, racist, sexist, threatening, sexually explicit, or otherwise inappropriate
• Submit content that infringes on any third party’s intellectual property rights
• Attempt to circumvent the one-play-per-day limit through any technical means
• Use automated scripts or bots to interact with the App
• Attempt to reverse engineer, hack, or otherwise compromise the App’s security

Your answer to the daily prompt is processed in real time by Anthropic’s Claude AI to generate a score and explanation. This score is entirely subjective and for entertainment purposes only. It does not reflect any objective assessment of your intelligence, creativity, or abilities. AI-generated content may occasionally be inaccurate or unexpected. We are not responsible for the content of AI-generated responses.

You retain ownership of the answers you submit. By submitting an answer, you grant Zaela LLC a limited, non-exclusive license to transmit your answer to Anthropic’s API for the sole purpose of generating your score. We do not store your answers, use them for AI training, or use them for any purpose beyond generating your real-time score.

The App, including its design, code, prompts, and branding, is owned by Zaela LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may request account deletion at any time by contacting info@zaelasolutions.com.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZAELA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED $100.

You agree to indemnify, defend, and hold harmless Zaela LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the App or violation of these Terms.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the state or federal courts located in Ohio, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We reserve the right to modify these Terms at any time. We will indicate the date of the most recent update at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zaela LLC regarding the App and supersede any prior agreements.
